DACA

Acción Diferida para los Llegados en la Infancia

(“DACA”)

DACA es una forma de exención administrativa para remoción. El gobierno aplicará su discresión para la Acción Diferida, es decir, no buscar su deportación por un período de dos (2) años.

Para ser candidato a aplicar a DACA, debe reunir los siguientes requisitos:

  • Haber sido menor de 31 años de edad al 15 de junio de 2012;
  • Haber ingresado a los Estados Unidos antes de cumplir 16 años;
  • Haber residido de manera continua en los Estados Unidos desde el 15 de junio de 2007, a la fecha;
  • Debe haber estado físicamente presente en los Estados Unidos el 15 de junio de 2012, y al momento de hacer su petición para consideración de acción diferida con USCIS;
  • No haber tenido un estatus legal el 15 de junio de 2012, lo que significa que:
    • Nunca ha tenido un estatus legal en o previo a junio 15 de 2012 o
    • Cualquier estatus legal o condicional que haya obtenido previo al 15 de junio de 2012 había expirado para esa fecha.
  • Debe estar en la escuela, o haberse graduado u obtenido un certificado de preparatoria, o haber obtenido un certificado de Desarrollo Educativo General (GED, en inglés, General Educational Development), o ser un veterano honorablemente dado de baja de la Guardia Costera o las Fuerzas Armadas de los Estados Unidos; y
  • No haber sido condenado por ningún crimen, delito menor significativo, tres o más delitos menores ni ser una amenaza para la seguridad nacional o la seguridad pública

“Un Delito Menor Significativo”

Sin importar la sentencia impuesta, es un delito de violencia doméstica, abuso sexual o explotación, escalamiento, posesión o uso ilegal de armas de fuego; distribución o tráfico de drogas o manejar bajo los efectos de alcohol o drogas

DACA no otorga un camino hacia la residencia legal permanente o ciudadanía.

DACA es otorgado por un periodo de dos años.  Las peticiones para su renovación son otorgadas también por periodos de dos años. Los aspirantes cuyas peticiones por DACA sean aprobadas pueden aplicar para autorización de empleo.

Las personas que obtengan un DACA podrán aplicar para obtener un permiso de viaje llamado “Advance Parole”. Esta es una aplicación que se hace ante el USCIS (Servicio de Ciudadanía e Inmigración de los Estados Unidos de América, en inglés: United States Citizenship and Inmigration Services) para permitirle al inmigrante viajar fuera de los Estados Unidos y reingresar de manera legal. La aplicación debe ser aprobada antes del viaje. Para jóvenes indocumentados, el permiso de viaje les brinda la oportunidad de salir del país y retornar, sea por motivos de estudio o trabajo y/o visitar parientes enfermos o de edad avanzada de los cuales hayan permanecido alejados por muchos años. No obstante, esto no es una garantía de re-admisión. El DHS puede revocar un permiso de viaje en cualquier momento, especialmente si el viajero ha tenido serios problemas de inmigración previamente como una orden de revocamiento anterior. Los motivos válidos y la duración del viaje son limitados a casos humanitarios, educativos y/o de empleo.
